WASHINGTON — Tonight’s little constitutional indigestion comes from the Treasury Department, where Elon Musk’s DOGE operation has moved into the federal payment-system neighborhood. You know, the part of government that handles tax refunds, Social Security payments, veterans’ benefits, and enough sensitive personal data to make a North Shore identity-theft scammer blush.
On Monday, the Alliance for Retired Americans, the American Federation of Government Employees, and the Service Employees International Union filed suit against Treasury Secretary Scott Bessent, Treasury, and the Bureau of the Fiscal Service. Their complaint seeks to stop what it describes as the ongoing disclosure of personal and financial information to Musk and DOGE personnel, alleging violations of the Privacy Act, the Administrative Procedure Act, and statutory limits on access to records.
The lawsuit is an allegation, not a court finding — let’s not launch the empty Michelob bottles before the evidence gets its hearing — but the stakes are plain. NPR reported Monday evening that DOGE had gained access to Treasury payment systems and that the new lawsuit argues this could expose information tied to tax refunds, disability payments, and veterans’ benefits. The White House said Musk is serving as a special government employee and that he acts with White House approval.
That is not a minor paperwork kerfuffle at City Hall. It is a fight over who gets access to the financial plumbing of the United States, under what legal authority, and whether the people opening the valves have been subject to the normal safeguards. In Boston terms: somebody handed a stranger the master key to the basement, then acted surprised when the whole block asked who checked his ID.
Government efficiency is a fine goal. So are onion rings. Neither requires skipping the rules designed to keep Americans’ bank-account and Social Security information from becoming a roadside CB-radio topic. The lawsuit now puts the questions in federal court, where — wild concept — the government may have to explain the legal basis for letting DOGE into the data room.
